The ‘Best Buy’ Online — Samsung 52″ 9.99

August 12, 2009

Get your credit cards ready because the ‘Best Buy’ online has just exploded on the scene. Sometime early this morning, consumers were shocked to see a Samsung 52″ LCD TV LN52A650 on sale for a ridiculous $9.99. While it is obvious that this is a pricing error on the part of Best Buy, one can only hope and dream that Best Buy lets Christmas come early.

For anyone wondering about Best Buy’s Pricing Error policy it is here as follows:

Under the Conditions of Use:

Errors on site
Prices and availability of products and services are subject to change without notice. Errors will be corrected where discovered, and Best Buy reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Best Buy will issue a credit to your credit card account in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account. If you are not fully satisfied with your purchase, you may return it in accordance with Best Buy’s Return Policy

Aside from the $9.99 ‘believe or not’ price, California residents will have to pay a $25.00 recycling fee per unit and everyone will have to pay a $70.00 flat shipping charge. For mere $79 you can own this $1,500.00+ unit.

Updates to follow.

Since this post was last writing about 4 hours ago, Best Buy has since removed the product from its searches. Luckily the link in this post still works. I have tried it up until the point where I have to enter my credit card information and it seems to still work. Many sources have told me that the product is unsearchable, but nothing about not being able to checkout. So far, it appears that this is the only link that is working.

Here is the working link again: Samsung 52″ LCD TV LN52A650

Tip: Order low quantities (example: 1-3). It seems that from one of the comments that they will honor low quantity orders. Sorry to those that ordered 30.

Best Buy has just updated the product link and it now shows the price at $1,699.99. Sorry everyone, Christmas is over. Now it’s the waiting game to see what happens to the people that did order the product at $9.99.

Would be great to get some updates from Best Buy!

Just got a Tweet from Best Buy Rep, @Jacob_BBY

@Joseph_Yi Unfortunately all orders for that price will be canceled and refunded regardless of quantity.

I’m sure that people will still want to hear from Best Buy themselves, but perhaps this is an indication of what’s to come.

    Best Buy’s website states:

“The Best Buy Web site is created, operated and controlled by Best Buy in the State of Minnesota, United States of America. The laws of the State of Minnesota will govern the Legal Notices and Conditions of Use without giving effect to any principles or conflicts of laws.”

    According to Minnesota Law:

    “325F.67 FALSE STATEMENT IN ADVERTISEMENT.
Any person, firm, corporation, or association who, with intent to sell or in anywise dispose of merchandise, securities, service, or anything offered by such person, firm, corporation, or association, directly or indirectly, to the public, for sale or distribution, or with intent to increase the consumption thereof, or to induce the public in any manner to enter into any obligation relating thereto, or to acquire title thereto, or any interest therein, makes, publishes, disseminates, circulates, or places before the public, or causes, directly or indirectly, to be made, published, disseminated, circulated, or placed before the public, in this state, in a newspaper or other publication, or in the form of a book, notice, handbill, poster, bill, label, price tag, circular, pamphlet, program, or letter, or over any radio or television station, or in any other way, an advertisement of any sort regarding merchandise, securities, service, or anything so offered to the public, for use, consumption, purchase, or sale, which advertisement contains any material assertion, representation, or statement of fact which is untrue, deceptive, or misleading, shall, whether or not pecuniary or other specific damage to any person occurs as a direct result thereof, be guilty of a misdemeanor, and any such act is declared to be a public nuisance and may be enjoined as such.
The duty of a strict observance and enforcement of this law and prosecution for any violation thereof is hereby expressly imposed upon the attorney general, and it shall be the duty of the county attorney of any county wherein a violation of this section shall have occurred, upon complaint being made, to prosecute any person violating any of the provisions of this section.”

So, the law explicitly states that “whether or not pecuniary or other specific damage to any person occurs”…”any such act is declared to be a public nuisance”…

The law requires the attorney general to “prosecute any person violating any of the provisions of this section” simply because the false ad was a public nuisance.

However, the law requires this “upon complaint being made”

My recommendation – if Best Buy does not honor their advertised price then file a complaint with both the Minnesota Attorney General as well as your home State’s Attorney General.

Also, a website’s Terms and Conditions cannot trump State laws…which is why their website terms are “governed by” the laws of Minnesota.

I’ve tried ordering about 40 times and it keeps saying their delivery system is down and to try again later. Damn…..

  • 9.99 tv August 12, 2009 at 8:24 am

the friend that called me at 1am this morning said his buddy got through to customer service. they said they were honering those that ordered one tv but the greedy people that ordered 30 each are not going to get them. i dont put that much faith in my friends friend but we will see i checked my order and delivery date is still the 17th.

  • Evan August 12, 2009 at 8:24 am

I have been trying to order all morning. I keep getting an error: “Delivery System Unavailable” and I am unable to select the “store pickup” option.

Do you think they disabled both options to purchase so that people would just come to the bestbuy site or something?

  • 123456 August 12, 2009 at 8:31 am

    ordered 2!

  • best buy August 12, 2009 at 9:21 am

they are not honoring this. the state attorneys office said that if they have the disclaimer they are fine and dont have to honor it. Best buy will be refunding all those who did “purchase” the tv.

  • Ron Patel August 12, 2009 at 10:14 am

I just called customer service @ 1-888-237-8289 and they said “it was a pricing error and all the orders will be canceled and you will get a refund.”

  • Narhan August 12, 2009 at 10:17 am

Regardless of the error if BestBuy does not honor the integrity of their Website purchases is gone.

  • Narhan August 12, 2009 at 10:20 am

In addition the BestBuy Website should be on Googles no confidence list. Website to avoid.

  • german osorio August 12, 2009 at 10:32 am

hey i bought 100 of these, is there any way that we can fight for it? make them honor the sale???

I work the night shift and was told about this by someone who just happened to be on the site. I only ordered one and called my parents and they ordered one. A few people did get greedy and ordered up to 11 (no, not a Spinal Tap joke). I would love it if at least my parents got their’s and hopefully I could get mine. As for the greedy people, screw ’em.

  • Jessica August 12, 2009 at 12:20 pm

Just got the cancellation email, and I only ordered one. Full refund, typographical error, sorry for the inconvenience.

Saw it coming, but oh, well.

  • Brad August 12, 2009 at 3:32 pm

They honored the palm pre price error of $99. I know this is a big price difference but shouldnt they do the same thing and honor it? If they knew that there was an error for the palm pre they could of stopped or cancelled it.

  • Chris August 12, 2009 at 4:03 pm

This is what they sent me, LOL can we do anything about this??

    i only ordered 3 haha

    Someone said:

“Regardless of the error if BestBuy does not honor the integrity of their Website purchases is gone.”

And to the others that want to “make” em honor it.

REALLY?!?!?!? When you saw a 52″ LCD 1080P TV for $9.99, did you honestly think that it was a legitimate deal? C’mon, people make mistakes and everyone that ordered one knew without a doubt it was a mistake and too good to be true and that there was no way you were getting a $3,000 television for 10 bucks.

  • Sameer August 12, 2009 at 4:20 pm

If anyone does get their tv’s i am willing to pay for some of them.

YEAH REALLY…. regardless if they made a mistake a big company like Best Buy needs to take responsibility and honor these prices. Even if there is a policy, the people who ordered it before the error was caught hould get their TV’s.

I assume either you A.) work for Best Buy or B.) one of the many that tried to order a TV after the error was caught.

  • Chris August 12, 2009 at 5:43 pm

LOL, im pissed at the people who ordered over 5 i know a couple people who ordered well over 100 , Like really!! i would be happy if they just honored 1 to each person who filed a complaint.

  • Will August 12, 2009 at 6:34 pm

My problem with this is that once the “typo” first went out shipping was free. Then as time went on shipping jumped to 70.00. To me that means some one knew something. You change shipping prices but not the price of the TV.

  • Daryl August 12, 2009 at 7:10 pm

In reality, the samsung is around 18 hundred dollars. With shipping and the recycling fee, the total was about a hundred a dollars or so. That is a net loss of well over $1,700 dollars a television. Do you really think Best Buy will honor anything regardless of the quantities, even for the hopefuls who bought just ONE. Be real everybody. It’s not a free television giveaway. I’m going to guess about 1000 people ordered just one tv. I’m sure with the struggling economy, Best Buy is not going to honor an almost 2 million dollar giveaway due to a glitch or manual malfunction.
Maybe if it was a new release video game advertised for 9.99 on accident, then we may see them honor prices, but not for a tv selling for 1,800 dollars

  • E August 12, 2009 at 10:00 pm

I called Best Buy and told them about the error early this morning. They said they really appreciated the notification and they are sending me one TV for free. Take that all of you greedy bastards!!!
